On Monday June 28 PRCS filed its appeal of the Point Roberts Beach Club DNS.

Tyler Schroeder, current planning supervisor of Whatcom County Planning and Development Services (PDS), has informed the Hearing Examiner that, as a result of the appeal, PDS would not be ready to hold the hearing by mid-July as previously expected. The Hearing Examiner has set the hearing date on August 13, 2010.  A public foreclosure notice has been posted at the Phase 1 40-acre project site (known locally as the “Butler" parcel).   The bank intends to hold a foreclosure sale of the property on September 17, 2010.

This brings pressure on Lily Point LLC as they are playing a game of trying to move their permit process forward in an attempt to prove to the bank that they will develop the property, sell lots and pay the bank off.
And it raises legitimate questions about the developer’s actual ownership of the property and ability to retain control over the property in order to bring to fruition its development plans.

Lily Point LLC will need to re-negotiate with the bank in order to continue with the development plans.

If you recall Stanton Northwest filed for bankruptcy this past May.  The Bank is owed over 3.6 million dollars and the county is owed back property taxes. 

Our lawyer tells us that as a community we have no legal recourse if Lily Point LLC breaks ground, runs out of money and leaves us an awful mess to look at and most importantly, a damaged ecosystem.  We cannot allow this to happen.

PRCS has paid $750 just for the DNS appeal filing fee.  We have used much of our retainer with our lawyer and must budget what we need for document preparation for this round.   But we can’t do this alone.

PRCS Benefit Walk in Pictures

Although the weather started out cloudy with drizzles, The Point Roberts Conservation Society Benefit Walk turn out to be a beautiful day.

History of the Point Roberts Conservation Society

In 1988, a small group of concerned and dedicated neighbors, led by Larry and Aileen Crosetti, banded together to fight the proposed commercial development of Lily Point by Welsh Development Inc. The plan was to develop 132 acres of the former Alaska Packers Association (APA) property to create “The Resort at Lily Point,” consisting of a 72 room hotel, 18 hole golf course, three story 94 unit condominium, and 47 single family residential lots.

I am totally opposed to a 103 home housing development on Lily Point, Point Roberts. How the protection of this highly significant area in the Boundary Bay watershed can now be threatened by housing developments is extraordinary.
